The Supreme Court on Monday announced a halt to a proposal put forth by a previously constituted judicial committee regarding its November 20, 2025, judgment that had accepted a 100-meter height definition for the Aravalli hills.
The order of earlier ruling to be kept “in abeyance” until a new high-powered domain expert can undertake a comprehensive assessment of the committee’s report was ordered by a bench comprising Chief Justice Surya Kant and J.K. Maheswari, and A.G. Masih fixed the matter for the next hearing on January 21, 2026.
Following a substantial environmentalist and public outcry over the implications of the judgment, the bench initiated suo motu proceedings.
It was observed by the court that both its own subsequent judgment and the committee’s report seemed to have omitted to clarify certain critical issues in detail.
The “significant outcry among environmentalists” was acknowledged by the bench, noting their great concern about the improper implementation and misinterpretation of the new definition. This dissent, the court stated, stems from “perceived ambiguity and lack of clarity in certain terms and directives,” creating a “dire need to further probe and clarify to prevent any regulatory gaps that might undermine the ecological integrity of the Aravalli region.”
In order to address these concerns, it was stated by the Supreme Court that prior to the implementation of the report or the execution of earlier judgments’ directions, an impartial, independent, and fair expert opinion must be taken into account, after associating all the requisite stakeholders.
Hence, the bench suggested a High-Powered Expert Committee composed of domain experts to thoroughly evaluate the prior committee’s submission.
It is necessary that the halt happens to subserve the ends of complete justice and in the broader public interest, as emphasized by the bench, and it will remain effective until the present proceedings reach a logical conclusion. The main purpose is to ensure that no irreversible administrative or ecological actions are taken based on the recent framework.
